Luxuryce may disclose Users’ personal

Sellers from whom you
have purchased items

When you buy an item on Luxuryce, if the seller
does not elect to use her own shipping materials, the seller receives a
Luxuryce-branded shipping kit with a pre-paid, pre-addressed postage label with
your full street address. The information will only include that which is
necessary and relevant to successfully complete your order. The seller is
strictly prohibited from using your information for anything other than completing
the sale.

Business partners,
trusted affiliates, and third party service providers

We may disclose generic aggregated demographic
information not linked to any personal information regarding visitors and users
with our business partners, trusted affiliates, and advertisers, without
notification to the User of such disclosure. We may use third party service
providers to help us operate our business and our Website or administer
activities on our behalf, such as sending newsletters or surveys. We may
disclose your information, including your personal information, to these third
parties only to the extent necessary for them to provide such services to us
and such third party service providers are contractually obligated to maintain
the confidentiality and security of that information. These third parties may
be located outside of your country of residence, including but not limited to

an order to provide service to that order. We only share this personal
information with third-party payment providers, including Stripe, PayPal or

Corporate Transactions

In the event of a sale, amalgamation,
re-organization, transfer or financing of parts of some or all of Luxuryce’s
business (“Transaction”), your personal information may be disclosed
to an acquiring organization either as part of due diligence or on completion of
the transaction. If your personal information is ever disclosed in this
context, Luxuryce will require the acquiring organization to agree to protect
your personal information in accordance with this Privacy Policy and to only
use your personal information for purposes relating to the Transaction. You
acknowledge and consent that such transfers may occur and are permitted by this

Luxuryce’s complaint procedure, as outlined in our Terms of Use Agreement

necessary and relevant in connection to an intellectual property infringement,
fraud investigation, or other unlawful activity to which the third party has
been subject, as detailed in our Verified Rights Owners Program (Section 12 in
our Terms of Use Agreement located at Terms). Disclosed personal information may include, but is not limited
to, User’s name, mailing address, phone number, and email address. Disclosure
may be made without notice to User.

For avoidance of doubt, please take note that
disclosing personal information to third parties with intellectual property
rights includes the disclosure of personal information of a User who has been
identified as selling unauthorized goods or replica items, which is in
violation of our Terms of Use Agreement.

Third parties in a legal
proceeding

We may disclose User’s personal information to
third parties involved in a legal proceeding if the third party provides
Luxuryce with a subpoena or other similar lawful process. Disclosure may be
made without notice to User.

Luxuryce will also disclose to third parties
involved in a legal proceeding when Luxuryce believes in good faith that
disclosing personal information is necessary to prevent imminent physical harm
or financial loss, or to report suspected illegal activity.

Luxuryce Users

We may use user information obtained from
account activity including total number of sales, last active timeframe, and
message response time, in order to provide seller performance information to
Luxuryce users.

Disclosure related to
Luxuryce’s Terms of Use Agreement

If Luxuryce believes in good faith that a User
has breached the Terms of Use Agreement or any other Luxuryce agreement,
Luxuryce may disclose such User’s personal information as found necessary and
relevant to pursuing a claim or preventing further injury to Luxuryce, its
Users, and others. Disclosure may be made without notice to User.

Advertising

Third party websites

Users may find advertising or other content on
our Website that links to the sites and services of our partners, suppliers,
advertisers, sponsors, licensors, and other third parties. We do not control

Advertisements appearing on our Website may be

Right to Request
Personal Information Collected

If we collect personal information about you,
you have the right to request that we disclose to you certain information about
our collection and use of your personal information over the past twelve (12)
months. Once we receive and verify your consumer request, we will disclose to

Right to Request
Deletion

You have the right to request that we delete any
of your personal information that we collected from you and retained, subject
to certain exceptions set forth below. Once we receive and verify your consumer
request, we will delete (and direct our service providers to delete) your
personal information from our records, unless an exception applies.

We may deny your deletion request if retaining
the information is necessary for us or our service providers to:

    with consumer expectations based on your relationship with us;

Right Not to Be
Discriminated Against

You have the right to not be discriminated
against by a business for exercising any of your rights under the CCPA. Unless
permitted by the CCPA, we will not:

 

  • Deny goods or Services to you;
  • Charge you different prices or rates for goods or
    Services, including through the use of discounts or other benefits or
    imposing penalties;
  • Provide a different level or quality of goods or
    Services to you; or
  • Suggest that you will receive a different price or rate
    for goods or Services or a different level or quality of goods or Services.

How to Exercise Your
Rights

Upon receipt of a verifiable request from you to
access or delete your personal information we shall promptly take steps to
disclose and deliver or delete as applicable, free of charge to you, the
personal information in accordance with Cal. Civil Code §1798.100 (d). Please
note that only you, or a person registered with the California Secretary of
State that you authorize to act on your behalf, may make a verifiable consumer
request related to your personal information. You may also make a verifiable
consumer request on behalf of your minor child. To be a verifiable consumer
request, the request must:

 

  • Provide information sufficient to allow us to
    reasonably verify you are the person about whom we collected personal
    information or an authorized representative; and
  • Describe your request with detail sufficient to allow
    us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you
with personal information if we cannot verify your identity or authority to
make the request and confirm the personal information relates to you. We will
only use personal information provided in a verifiable consumer request to
verify the requestor’s identity or authority to make the request.

Response Timing and
Format

Upon receiving a verifiable request, we will
confirm receipt of the request within ten (10) days and indicate when you
should expect a response. We endeavor to respond to all verifiable requests
within forty-five (45) days from the day that we receive the request. If we
require additional time to respond to your request, we may take up to an
additional forty-five (45) days to respond, in which case we will provide you
with notice and an explanation for the delay.

We will deliver a written response by mail or
electronically. Any disclosures we provide will only cover the twelve (12)
month period preceding the verifiable consumer request’s receipt. The response
we provide will also explain the reasons we cannot comply with a request, if
applicable. For data portability requests, if provided electronically, the
information shall be in a portable and, to the extent technically feasible, in
a readily useable format that allows you to transmit this information to
another entity without hindrance.

Please note that while we may provide personal
information to you in response to your verifiable request, we are not required
to provide personal information to you more than twice in a twelve (12) month
period.

California Civil Code Section 1798.83 permits
customers of Luxuryce who are California residents to request certain
information free of charge regarding its disclosure of their personal
information to third parties for their direct marketing purposes. To make such
a request, please send an e-mail to [email protected] We may (and we may
allow third-party service providers to) use cookies or similar technologies to
collect information about your browsing activities across different websites
after you have used our Services. Our Services do not respond to “Do Not
Track” (DNT) signals and operates as described in this Privacy Policy
whether or not a DNT signal is received.
